TERMS AND CONDITIONS

  1. Introduction

1.1. These Terms and Conditions define the rights and obligations of the parties when concluding a purchase contract between MoneyCoin s.r.o., registered office Rybná 682/14, Staré Město, 110 00 Prague 1, Company ID 17555922 (hereinafter the “Seller”), as the seller operating a physical store at its registered address and an online store (e shop) at https://goldenhouse.cz, and the Buyer when making purchases in the e shop and physical stores.

1.2. By submitting an order, the Buyer confirms that they have read these Terms and Conditions and agree with them.

1.3. These Terms and Conditions further regulate certain rights and obligations of the parties in relation to the Framework Agreement on the Purchase and Sale of Gold “Gold Savings” (hereinafter “Gold Savings”).

  1. Rights and obligations of the Seller

2.1. The Buyer may place an order or conclude a purchase contract via the e shop, personally at the Seller’s branches, in writing, by phone or by email.

2.2. The Seller reserves the right to refuse or not accept an order if:

the number of received orders exceeds the available stock of goods
the information provided about the Buyer or the delivery address is misleading, incorrect or incomplete, and or if the Buyer has previously breached their obligations towards the Seller, especially by not collecting or not paying for goods
the prices published on the website are evidently incorrect for any reason
the price of goods supplied by the Seller’s supplier changes significantly
the Buyer does not meet legal AML requirements
for any other reason.

2.3. The Seller is obliged to deliver the goods according to the binding order, meaning to send the ordered goods to the address stated in the order within three working days from confirmation of the order, and in the case of advance payment within three working days from the crediting of the payment to the Seller’s account. If the product description states a longer delivery period, the Buyer accepts this longer delivery time. In the case of a binding order of investment metals at a special price with delivery in 12 months (as defined in Article 4.3. below), the Seller is obliged to send the ordered investment metals within three working days from the moment the 12 month period expires.

2.4. A binding order means an order sent by the Buyer and confirmed by the Seller. The confirmation is sent to the Buyer’s email address as stated in the order, and in the case of advance payment it includes a pro forma invoice.

2.5. Orders are processed in the order in which they are received by the Seller.

2.6. The Seller reserves the right to issue a pro forma invoice for the full amount of the order for any order.

  1. Rights and obligations of the Buyer

3.1. The Buyer places orders at the Seller’s premises or via the e shop, either once without registration or with registration of a customer account, or in writing, by phone or by email.

3.2. The Buyer has the right to create a customer account on www.goldenhouse.cz. The Buyer acknowledges that in the case of Gold Savings an account is always created. The Buyer must enter correct data and update it in case of changes. After the account is created, the Buyer receives login details. The Buyer must keep these details confidential. The Seller is not responsible for the loss or misuse of login details caused by the Buyer. The Seller may cancel the account at any time.

3.3. The Buyer must provide correct data in the order, including the postal address for delivery.

3.4. The Buyer undertakes to collect the goods and pay the full price of the order including any additional fees such as shipping or packaging.

3.5. The Buyer may cancel an order placed via the e shop or by email by sending written notice to the Seller’s email address within 3 hours of submitting the order.

3.6. The Buyer must pay the full price of the order by the due date stated on the pro forma invoice. If payment is not received on time, the Seller will cancel the order.

3.7. Ownership of the goods transfers to the Buyer upon receipt. In case of shipping, ownership transfers upon receipt of the goods at the Buyer’s chosen delivery location. If the Buyer damages or destroys the goods before ownership transfers, they are liable for damages.

  1. Price

4.1. All product prices are listed on www.goldenhouse.cz. These are final prices including all taxes and fees except additional costs for shipping, payment method and insurance. The price for the same product may vary depending on the delivery time.

4.2. Prices of investment bars and coins (investment metals) change according to international markets. The Seller updates these prices several times a day. Price fixation for orders over 100000 CZK is confirmed only after the advance payment is credited to the Seller’s account. Payment must be received by 16:00 on the same business day the invoice is issued. The price fixed is the price at the moment of payment receipt. If payment is delayed and the market changes by more than one percent either direction, the Seller will charge or refund the difference. Trading occurs only on business days between 8:00 and 16:00. Orders placed outside trading hours are processed the next business day at current prices. If the price differs by more than one percent, the Buyer is contacted to confirm or cancel the order. Final payment must be credited by 16:00. In case of delay and more than one percent market movement, the Seller adjusts the price.

4.3. The special price with delivery in 12 months is a reduced price for investment metals, which are delivered within three working days after the 12 month period expires.

4.4. Prices include VAT.

4.5. Shipping, packaging and insurance may be increased depending on the order and delivery address. Any increase must be stated in the order confirmation.

4.6. The Buyer pays for goods based on a pro forma invoice sent upon order confirmation by bank transfer or in cash at the Seller’s branches.

4.7. Cash payments may be made at the Seller’s branches up to 240000 CZK.

4.8. The Buyer may pre order commemorative coins. The Seller sends a pro forma invoice for 25 percent of the expected sale price. The final price is communicated after the coin’s release. The Buyer does not have to accept the final price and must inform the Seller immediately. If rejected, the Seller must refund the advance payment within 3 working days.

4.9. In Gold Savings, the fulfilment for the Target Bar is expressed as a weight of gold and the Buyer purchases Partial Gold at the price set by the Seller.

  1. Delivery

5.1. The Seller hands over goods in stock to the carrier within three working days after payment of the pro forma invoice. This does not apply to investment metals purchased at a special price with delivery in 12 months.

5.2. The Buyer accepts that the exact delivery time by the carrier cannot be guaranteed and may be extended.

5.3. Delivery may be made as follows:

personal collection at the Seller’s premises after payment
delivery by Czech Post
delivery by other courier services such as UPS, FedEx or DPD.

5.4. Every shipment is insured for the full value. Goods are sent as insured letter or insured package.

5.5. Shipping costs abroad are determined by destination and stated in the order confirmation. Shipping always includes insurance up to full value.

5.6. Delivery fees are listed on the e shop.

5.7. If the Buyer does not receive the shipment within the expected delivery time, they must inform the Seller without delay.

5.8. If the Buyer does not collect the goods within 3 working days or does not accept the shipment, and not even after an additional notice, the Buyer must inform the Seller within 3 working days how to proceed. The Seller may charge additional delivery costs.

  1. Complaints

6.1. If the Buyer is a consumer, a statutory warranty of 24 months applies. Claims are governed by the Civil Code.

6.2. Complaints may be submitted by email to info@goldenhouse.cz or in person at the Seller’s showroom.

6.3. Complaints must be submitted immediately after discovering a defect. The Buyer cannot claim a defect already discounted or a defect they knew about at the time of receipt.

6.4. A complaint must include the order number, invoice copy and detailed description of the defect.

6.5. The Seller processes complaints usually within 3 working days, no later than 30 days.

6.6. For non investment products, the Buyer has a right to withdraw within 14 days under the Civil Code.

6.7. For investment products, withdrawal within 14 days is excluded because prices depend on financial market fluctuations.

6.8. If the Buyer is an entrepreneur, withdrawal is only possible under the Civil Code.

6.9. In justified complaints, the Buyer has the right to reimbursement of necessary postage. In unjustified complaints, neither party has the right to reimbursement unless the complaint was abusive.

6.10. If a purchase contract for investment products is frustrated due to the Buyer, the Seller may charge a contractual penalty of 15 percent of the product price.

  1. Personal data

7.1. Processing of personal data complies with GDPR.

7.2. The Seller will not sell or provide personal data to third parties and uses it only to fulfil the purchase contract and improve communication.

7.3. Data will be deleted upon the Buyer’s request. The Buyer has access and correction rights.

7.4. The Seller may provide necessary data to carriers.

7.5. Customer satisfaction surveys may be sent via Heureka.cz under legitimate interest. The Buyer may object at any time.

  1. AML

8.1. The Seller is an obliged entity under the AML Act and must perform identification and verification of clients.

8.2. Identification is required when:
a) concluding a Gold Savings agreement or custody agreement
b) a one off transaction of at least 15000 EUR
c) transactions with precious metals of 10000 EUR or more including linked transactions
d) clients with higher risk including politically exposed persons.

8.3. The Buyer must provide the necessary identification data.

8.4. Verification is carried out primarily via BankID or in person if not available.

8.5. Transactions requiring verification must be paid only from an account held in the Buyer’s name. Goods are shipped only after successful identification.

8.6. The Seller does not provide services to sanctioned persons or residents of sanctioned countries.

8.7. If identification cannot be completed, the Seller may refuse the transaction and must report suspicious activity.

8.8. Data obtained for AML is stored for 10 years.

  1. Dispute resolution and final provisions

9.1. All relationships and disputes are governed by Czech law and resolved by Czech courts.

9.2. The contract is concluded in Czech. If translated, the Czech version prevails.

9.3. Contracts are archived internally for at least three years unless legislation requires longer.

9.4. If these Terms and Conditions do not state otherwise, relations are governed by the Civil Code.

9.5. These Terms and Conditions are valid and effective from 1 May 2024 and replace previous versions.
